Robert's Ruling On Obamacare - Leftist or Genius?

What a day Thursday was....the commentary about the Obamacare ruling was completely explosive and all over the map. I admit I thought there would be some surprises... but not one with Roberts siding with the usual big government Lefties of SCOTUS! (Sotomayor, Kagan, Ginsberg, and Breyer)

So was Roberts in agreement that this type of Socialist healthcare scheme is actually in accordance with the Constitution or was he using this as a vehicle for other more important statements from the court?
There are many opinions floating around about this.

Peter Schiff had this to say:



On the other hand, some seem to think that this ruling by Roberts actually could be of some benefit, even though the onerous and Socialist legislation was left to stand.
Here’s what really occurred — payback. Yes, payback for Obama’s numerous, ill-advised and childish insults directed toward SCOTUS.
Chief Justice Roberts actually ruled the mandate, relative to the commerce clause, was unconstitutional. That’s how the Democrats got Obama-care going in the first place. This is critical. His ruling means Congress can’t compel American citizens to purchase anything. Ever. The notion is now officially and forever, unconstitutional. As it should be.
Next, he stated that, because Congress doesn’t have the ability to mandate, it must, to fund Obama-care, rely on its power to tax. Therefore, the mechanism that funds Obama-care is a tax. This is also critical. Recall back during the initial Obama-care battles, the Democrats called it a penalty, Republicans called it a tax. Democrats consistently soft sold it as a penalty. It went to vote as a penalty. Obama declared endlessly, that it was not a tax, it was a penalty. But when the Democrats argued in front of the Supreme Court, they said ‘hey, a penalty or a tax, either way’. So, Roberts gave them a tax. It is now the official law of the land — beyond word-play and silly shenanigans. Obama-care is funded by tax dollars. Democrats now must defend a tax increase to justify the Obama-care law.
Finally, he struck down as unconstitutional, the Obama-care idea that the federal government can bully states into complying by yanking their existing medicaid funding. Liberals, through Obama-care, basically said to the states — ‘comply with Obama-care or we will stop existing funding.’ Roberts ruled that is a no-no. If a state takes the money, fine, the Feds can tell the state how to run a program, but if the state refuses money, the federal government can’t penalize the state by yanking other funding. Therefore, a state can decline to participate in Obama-care without penalty. This is obviously a serious problem. Are we going to have 10, 12, 25 states not participating in “national” health-care? Suddenly, it’s not national, is it?
Ultimately, Roberts supported states rights by limiting the federal government’s coercive abilities. He ruled that the government can not force the people to purchase products or services under the commerce clause and he forced liberals to have to come clean and admit that Obama-care is funded by tax increases.
That being said; What is to prevent a future Congress from mandating the purchase of anything - like an American (union made) automobile and then monetarily punishing any citizen who doesn’t comply with that mandate via a "tax"? Certainly, it is understood that with his ruling, Roberts thinks that such a law is constitutional.
That isn't cool at all.

Kill the Bill (on FaceBook) had this to say:
Obama and the Democrat's health care law was declared 'constitutional' by the Supreme Court today. This decision was based on the argument that the constitution grants Congress the right to levy taxes. Unless the law is repealed, in 2014 every American will be required to purchase health insurance- or pay a tax for not doing so. What this essentially means is that the federal government now has absolute authority to require Americans to do anything they want them to do. Don't join the military? Pay a tax. Watch too much tv? Pay a tax. Use birth control? Pay a tax. Gay? Pay a tax. Use your freedom to assemble in a public square? Pay a tax. Don't submit all of your personal information, including detailed financial records, health records etc? That's right- it is all possible now- there is no longer a limitation on the power of the federal government. The congress' authority to levy taxes now supersedes all individual rights 'guaranteed' by the bill of rights. Am I surprised? No, absolutely not. This is always the inevitable result of giving someone the legal authority to levy taxes. It is just one more sign that we do not live in the America we thought we did.
My thoughts on this:
I thought it was a horrible ruling and Roberts should have sided with the other 4 Justices (Alito, Kennedy, Thomas and Scalia). He should have called it a mandate (because it is) and struck it down as being unconstitutional .. period.

But bottomline - this is a "tax" that can be repealed.

Anyone running in November with the message of repealing this onerous "tax", the biggest "tax" in US history, is most likely going to win their race given the anti-Obamacare sentiment nationwide. Chief Justice Roberts may have given Mitt Romney a campaign issue juggernaut (as if the economy wasn't already a campaign issue) on the basis that taxes are already too high and out of control. etc. etc.

also ... States can nullify this legislation... and we may very well see states do this. I will bet that money is flooding into the Tenth Amendment Center as you read this.

Lastly, it is of utmost importance that this ruling states that government mandates through the Commerce Clause, versus some sort of  "tax" levied by Congress to make you do or not do something,  are completely unconstitutional. That's actually a very good thing.
I can at least find solace in that.


I am hearing that 120 House members are already working to Repeal Obamacare and 26 states have started to work on Nullification of Obamacare.

A New Constitution Lurks



Bet you didn't know that a new Constitution has been written for our states!
It is lurking... and supported by the "One Worlders".

It's the CONSTITUTION FOR THE NEWSTATES OF AMERICA, and can be found in the book, THE EMERGING CONSTITUTION by Rexford G. Tugwell, published 1974 (Harper and Row). "A Constitution for the Newstates of America", was prepared by a team of social experimenters at the CENTER FOR THE STUDY OF DEMOCRATIC INSTITUTIONS, Fund for the Republic (Ford Foundation), Post Office Box 4068, Santa Barbara, California 93103.
The Center, its first objective accomplished, has appointed socialist-oriented University of Denver Chancellor Maurice B. Mitchell as its new head and may merge with the Aspen Institute for Humanistic Studies, a Colorado-based world government policy promotion agency.

The reason why I mention this is that some people are advocating for Constitutional Conventions to make changes and amendments to our Constitution. We should be very wary of a Constitutional Convention (Con-Con) because the whole Constitution can be changed and even replaced with something as obnoxious as this NewStates garbage. The warning signs are initiatives toward dissolving state, county, and local powers for centralized power. The NewStates Constitution ultimately seeks to control the population in "an emergency" (whatever government deems to be an emergency) and furthermore here are some other scary key parts:
Article 1-A Sec.1 - "Freedom of expression shall not be abridged except in declared emergency."

Article 1A Sec.8 - "The practice of religion shall be privileged..."

Article 1A Sec.15 - "Writs of habeas corpus shall not be suspended except in declared emergency."

Article 1B Sec. 8 - "Bearing of arms shall be confined to the police, members of the armed forces, and those licensed under law."

There is more - and I suggest you seriously take a look at this document... because it is where certain factions in government are marching us.  

You should know by now that our current economic “crisis” is the vehicle to set up a new government, especially as states begin to show signs of falling into bankruptcy. With the continued polarization of our country over marriage and reproductive rights, parental rights and gun rights (to name a few) it is not surprising that people will easily fall for the notion that an amended Constitution will help preserve certain rights and even balance the federal budget, when in fact a Con Con will merely be a Con Job.  It will in fact remove your rights and establish an elitist set of rules.

It is predicted that a document such as this NewStates Constitution would be adopted within 20 years time. There is a clear reason why the elites in power have created the financial situation that we are in, and have created a fear ridden population with regard to global terrorism. Case in point: We allow ourselves to be groped by government at airports. We allow our children to be treated as criminals in schools by being subjected to metal detectors, searches and and policing on school property. Our population is being trained and de-sensitized to constant surveillance and the trappings of a police state via traffic stops (etc.). People have gladly given up their rights - jettisoned their 4th amendment rights to privacy - for the illusion of "protection". They put devices in your car to track you,  and eventually want to make it common for people to have chips in their bodies so they can be tracked like inventory. That's not freedom. That's not what our troops fight and die for.

We see the daily assault on the Constitution by the President and others in Washington. We witness daily their complete and utter disregard for the law, and we seem to be unable to do anything. We think we see the answer to blocking this disgusting seizure of power by perhaps thinking we can further bind their hands with some changes to the Constitution... but think again.

A Con Con is extremely dangerous.
Don't fall into this trap.

The only way in which we can halt the abuse of power is to use our existing laws - the power of impeachment - the tool of recall - and the many other devices we have which include free speech, free press, petition, peaceful protest. We must remain committed to voting the people out of office who abuse their office and who violate their oath of office... and yes, we must be totally committed to vigilance in holding honest elections. We must be vigilant for we have for too long been trusting and allowed the wrong people to be driving this bus we call America.  Probably the best way to thwart the federal government's continual power grab is for States to invoke their 10th amendment rights!

Article 1, Section 8, of the U.S. Constitution enumerates the only powers that Congress has. All other powers belong to the States!! Congress has absolutely no power to write laws and mandates regarding health-care, education, gun rights, food safety, vaccinations, and anything else to control our lives - and when they do pass laws relating to those issues, those laws should only apply only to territories and possessions of the United States.  (Read the last Clause [18] in Article 1, Section 8).

Finally - It should be totally understood that the President can not, and should not, operate as a dictator issuing Executive Orders or mandating Agencies to ignore the Law. That he does this and is not taken to task for it is not only Congress's fault, but ours as well.

Anyway, we apparently have had decades of government run amok.
It must not continue.

It is entirely up to us - We the People - to restore the Republic.
Our government is based on The Consent of the Governed.
With regard to what we are witnessing coming out of Washington,
I do not Consent.

Happy Father's Day

My dad, Leonard Theodore, passed away in 1997 at the age of 77 years.
He was a terrific dad, a loving grandfather and a wonderful person.
I miss him so very very much.
I know he would be so proud to see what his grandchildren have accomplished so far.
He served in World War 2 in the Pacific, and then came home and raised a family.
He did wonderful things in his community - like being a Boy Scout Master - and working to help raise money for our synagogue. He was always there to help a neighbor in need. He was hard working guy. He was honest and loving and had a great sense of humor. He helped raise 3 children and he was always there when they got themselves into some sort of jam.
He was an avid bowler too - and bowled 2 perfect games in his bowling career.
One 300 game happened shortly before he died.
He was an avid Yankees fan.
Dad was an inspiration to me and I will always hold him dear in my heart.
Happy Father's Day dad, wherever you are in the universe!

Today commemorates the adoption of the flag of the United States by the Second Continental Congress in 1777.

Flag Day - the anniversary of the Flag Resolution of 1777 - was officially established by the Proclamation of President Woodrow Wilson on May 30th, 1916. While Flag Day was celebrated in various communities for years after Wilson's proclamation, it was not until August 3rd, 1949, that President Truman signed an Act of Congress designating June 14th of each year as National Flag Day.

U.S. Hits Disturbing Job Shift



Zerohedge reported that the U.S. has been undergoing a :
...gradual transition to a part-time worker society. We elaborated on this back in February when we noted that the quality assessment of US jobs indicates that this most disturbing trend is accelerating. Finally, yesterday, the BLS' latest jobs report confirmed that our concerns have been valid all along: as of May, part-time jobs just as disclosed by the Bureau of Labor Statistics hit an all time high, over 28 million! These are people who traditionally have zero job benefits, including healthcare and retirement, and which according to the BLS "work less than 35 hours per week." In other words, as little as one hour per week of "work" is enough to classify one a part-time worker. More disturbing: the increase in part-time jobs in May compared to April: 618,000, or the fifth highest on record. It gets better: when added with the 508,000 increase in part-time jobs in April, this is the largest two month increase in part time-jobs in history. Which means of course that full time jobs in May must have declined: sure enough, at a -266,000 drop in full time jobs, the quality composition of the NFP report was just abysmal and makes any reported "increase" in those employed into a sad farce.
...since the December 2007 start of the depression, full time jobs have declined by 6.9 million while part-time jobs have increased by 3.1 million.

More Americans are taking part-time work... it's any port in the storm, really.
Companies are not hiring "full timers" as much, because of the huge costs associated with that as a result of so many government requirements.

This summer, kids who have just graduated college are also finding it very difficult to find employment. A new study reveals more than half of recent college graduates are unemployed or underemployed! This does not bode well for all of them who have to start paying their student debt.

Bloomberg's Junk Food Schizophrenia

On the one hand NYC Mayor Bloomberg is the 16 oz. Soda Nazi... with a plan to ban the sale of soda and other sugar laden drinks over 16 oz.

On the other hand ... NYC Mayor Bloomberg and his administration are celebrating National Donut Day! Complete with Photo Ops and Proclamation by the Mayor himself!

To celebrate the historical milestone, Entenmann's will present a donation check for $25,000 to The Salvation Army, unveil the largest box of Entenmann's Donuts ever created along with custom-made donuts 1-foot in diameter, and share a Proclamation Letter from Mayor Bloomberg. Entenmann's will also be providing free donuts and The Salvation Army's Canteen truck will be providing free coffee from 7 a.m. - 1 p.m. at the southwest corner of Madison Square Park, 23rd Street & Broadway.

Soft drinks, bad... donuts, good.
(That ought to keep the NYC policemen who frequent donut shops happy)

That's the thing about being a micro-managing Nanny State Government.... you'd think they would show at least a measure of consistency, especially where so-called "public health" is concerned ... and it is obvious that there is none.
